A former President of the Nigerian Bar Association (NBA) and Senior Advocate of Nigeria (SAN), Dr. Olisa Agbakoba has declared without mincing words that calling for interim government is treasonable felony as there is no constitutional provision for an interim government in Nigeria’s constitution.
Agbakoba charged that those championing it must face the wrath of the law.
He made this statement in a work published by barristerng.com.
The senior lawyer’s comments came on the heels of warning issued by the Department of State Services (DSS) that certain politicians were plotting to bring an interim government into power and stop the President-elect, Bola Ahmed Tinubu, who won the 25 February Presidential Election, from being sworn in as president of Nigeria.
He held that though the presidential election might have held under the most challenging circumstance, but that since it produced a president-elect, this fact must be respected and accepted.
According to Agbakoba, Nigerians must reject the call for an interim government as the nation’s Constitution, “which has no provision for interim arrangements” must be respected.
He could not understand reasons for the call if the presidential candidates have accepted the democratic process by lodging petitions before the courts, asking on what basis would anyone consider that an interim government is a viable and legal alternative.
